TERMS & CONDITIONS
- The Spell Warehouse Sale 2025 is conducted by Spell Designs Pty Ltd (ABN 68 605 908 496) of Unit 1 / 14a Banksia Drive, Byron Bay, NSW, Australia, 2481 (“Spell”).
- Spell’s Warehouse Sale is for a limited time - 3 days only from 9am – 4pm (AEDT) from Friday, 17 January 2025 until Sunday, 20 January 2025 at our Spell Warehouse location and premises at 9 Acacia Street, Byron Bay, NSW, 2481.
- By entering the Spell Warehouse Sale, all customers, including Curators, will be deemed to have accepted and agreed to be bound by these terms and conditions of warehouse sale (“Conditions of Entry”).
- Management reserves the right to refuse entry to our Spell Warehouse Sale.
- All bags will be inspected upon exit and entry to the Warehouse Sale. Bags larger than a backpack will not be permitted and will remain the responsibility of the individual.
- Warehouse Sale stock is limited and is a mix of samples, seconds, faulty and discounted items. Please check and examine your garments thoroughly for defects and faults before purchasing, as all sales are final. It is the customers’ responsibility to check their garments for any faults prior to purchase before leaving the premises.
- Warehouse Sale stock is subject to availability. We aim to replenish stock however, not all Spell collections and sizes are available during our Warehouse Sale as may sell out.
- Spell will be operating a strict no returns, no credit, no exchange, no refunds policy on items purchased at the Warehouse Sale for change of mind, are misused items, or where customers were made aware of the fault or defect before and still purchased in accordance with the Australian Competition and Consumer Act 2010 (Cth)(Australian Consumer Law). Your consumer guarantees and rights still apply under the Australian Consumer Law.
- Customers cannot return, credit, exchange or refund Warehouse Sale items to our online store or boutique. Again, please carefully examine all goods before purchase as these are a mix of samples, seconds, faulty items, and discounted stock and our strict returns policy above. Your consumer guarantees and rights still apply under the Australian Consumer Laws 2010 (Cth).
- No items can be put aside on hold or left behind the counter. We cannot hold stock, so please help our team out and prepare your payment before reaching the counter, and manage credit card limits, and transfers prior to checkout. We cannot accept phone payments or credit cards that are not presented in person to our staff.
- Cash, EFTPOS and all major credit cards including VISA, Mastercard, and American Express are accepted as payment.
- Gift Cards, Gift Vouchers, Discount Codes, Curator’s Club discounts cannot be used.
- Please do not place stock in piles on the floors due to health and safety risks such as trip hazards and soiling of garments - please return all items to a team member to be hung-up if not wanted.
- Offensive, rude, intimidating, and disrespectful behavior will not be tolerated and such customers may be asked to leave our premises immediately.
- We may ask for your personal information including your name, email, telephone number at the checkout and if you wish to subscribe to opt-in to our database for sales and marketing purposes. Personal information provided to Spell will only be collected, used and disclosed in accordance with Spell’s Privacy Policy at https://aus.spell.co/pages/privacy-policy and will not be sold, reused, rented, loaned, or otherwise disclosed to any third party, otherwise than in accordance with Spell’s Privacy Policy and the The Privacy Act 1988 (Cth).
